The following terms and conditions (“Terms and Conditions”) apply to all travel and travel related Services offered for sale by Shiva Travel, and/or its agents, employees, associates, affiliated companies, independent contractors, or subcontractors (hereinafter referred to as “www.shivatravel.com”, “we,” or “us”). Our Terms and Conditions may be amended or modified by us at any time, without notice, on the understanding that such changes will not apply to Trips booked prior to the amendment or modification. It is therefore essential that you consult and accept our Terms and Conditions at the time of making a booking, particularly in order to determine which provisions are in operation at that time in case they have changed since the last time you placed an order with Shiva Travel or reviewed our Terms and Conditions.
All prices displayed on the web site are subject to change without notice. This is because the airlines and other Third Party providers may change the prices at any time. Special conditions may apply to the prices set out on the web site. To determine such conditions, you must contact us or the relevant Third Party provider. The prices set out on the web site may not include taxes or airport charges or other fees. In this case taxes, airport charges and any additional fees will be displayed during the booking process but prior to payment submission. Pricing is displayed in US currency.
Certain products, services and content available on the Shiva Travel are provided by third parties (the "Service Providers"), including, but not limited to, the air carriers, hotels, car rental agencies, cruise lines, tour operators, insurance carriers and other suppliers providing travel or other services on the Shiva Travel . In addition, certain software and data found on the Shiva Travel are the copyrighted property of the Service Providers and/or their third-party providers and distributors.
You may only use the Shiva Travel to make legitimate reservations or purchases and shall not use the Shiva Travel for any other purposes, including making any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You may not (a) use any "robot", "spider", or other automatic device, or a program, algorithm or methodology having similar processes or functionality, or any manual process to monitor or copy any of the web pages, data or content found on the Shiva Travel, (b) link to any portion of the Shiva Travel, without the prior written permission of Shiva Travel, (c) use the Shiva Travel in violation of, or to violate, any law, rule or regulation, or (d) "frame", "mirror", or otherwise incorporate any part of the Shiva Travel into any other website without Shiva Travel's prior written authorization. You acknowledge and agree that you will not use, nor will you permit any use of, the Shiva Travel in conjunction with any of your activities or business by anyone that resides, stays or is accessing the Shiva Travel from a country prohibited under U.S. export and/or Office of Foreign Assets Control regulations, including, but not limited to, regulations based upon sanctions, country programs against or embargoes. For more information regarding these regulations, visit www.treas.gov/ofac. You shall automatically become unauthorized to use the Shiva Travel in the event of a breach of this obligation. You specifically agree to indemnify and hold harmless Shiva Travel and the Service Providers for any breach of this "Use of Shiva Travel" section.
For refundable fares, a processing fee by Shiva Travel Customer Service may be charged for all permitted cancellations. All of airline’s service fees and airline tickets are NON-REFUNDABLE. Vacation protection insurance can be refunded within 10 days of purchase in case the travel has not begun and the customer has called the customer service of airline to cancel. All cancellations should be done via phone only. Refund requests will be accepted only after following conditions have been met:
For flight ticket refunds, it is difficult to provide exact date or time it may take for the refund process. All requests for refunds are processed in a sequence. Once a notification is sent to the customer service agent, an e-mail notification will be sent by us to confirm such request. However, this notification is just an acknowledgement of your request and does not automatically qualify you for a refund. Upon receiving the request, we work with the concerned airlines to arrive at a waived amount based on the rules of the airlines and then notify you the decision of the airlines. Please note that we depend on the airlines to receive refunds. After approval of refund by the airlines, it might take some additional time for the same to reflect in your credit card statement. Generally, a penalty is charged for refunds by all airlines. The entire process, from receipt of your refund request to reflection of the same in your credit card statement, might take 60-90 days. Apart from the refund penalties imposed by the airline, a fee for processing this refund will be charged by Shiva Travel. These fees will be assessed only if the airline has authorized the refund or a waiver has been received and when such refunds are permitted by rules of the airline. In case the airline does not process your refund, we will refund you the processing fees charged by us.
All airline tickets are completely non-refundable and non-transferable. In cases where the airline does allow cancellations, a credit may be valid towards ticket purchase in future with travel on flights of the same airline. Fare difference (if any) and the applicable penalty will be added in such cases. The time constraints and expiration date of such credit should be discussed before hand with the customer service agent. All such bookings that allow for cancellation must be cancelled prior to the scheduled departure time of the flight by calling our customer service representative. We do not guarantee any cancellation. At the time of booking cancellation, a cancellation fee of $50 per person per ticket is payable to us. This fee is retained by us. The credit available must be used within a certain time period and date or you will lose the credit amount. When making a new booking, you will have to pay the applicable fare difference, airline penalties and Travel including exchange fees. All such changes are governed by the rules and regulations of the airlines. No representations or guarantees on fees or changes are provided by Shiva Travel. For non-refundable fares, for any change in the itinerary after issuing of tickets (in case it is permitted by the airline), following change fees is applicable.
For itineraries where the airline permits changes, a change/exchange fee is charged by Shiva Travel, along with fare difference if any and airline penalties. The total cost of the exchanged ticket can be rightly ascertained by calling our customer centre. Our Ticket Exchange fees (not including airline penalty fees and fare difference)- For Domestic Travel where the Departure Date is more than 7 days away – up to $200, Domestic Travel where Departure Date is within 7 Days - $250, International Travel where Departure Date is more than 7 days away – up to $300, International Travel where Departure Date is within 7 days away $400. We make no additional representation for our exchange fees except the assistance of an agent in locating your new desired flights and making attempts to re-book new flights subject to availability and other factors.
The method for issuing travel documents and/or tickets depends on the time available between the date of issue of tickets and your date of departure, and/or the type of Service. If a Traveler provides incorrect information, Shiva Travel does not assume any liability if the Trip is adversely affected or made impossible by the non-receipt of travel documents. Travel documents will only be sent to the purchasing Traveler who places the order and personally agrees to these Terms and Conditions.
It is Traveler’s responsibility to verify they have all the necessary visas, passport, and vaccinations prior to travel. A full and valid passport is required for all persons traveling to any of the destinations outside the U.S. that we feature. You must obtain and have possession of a valid passport, all visas, permits and certificates, and vaccination certificates required for your entire Trip. Most out of international Trips (including India) require a passport valid until at least six (6) months beyond the scheduled end of your Itinerary. Non-U.S. citizens should contact the appropriate consular office for any requirements pertaining to their Trip. If you try to enter a country where visa is required, and you do not have the visa, it is possible that you will be imprisoned until there is an available flight to return you to your point of origin. India requires at least a Tourist Visa to visit. Some countries require you to be in possession of a return ticket or exit ticket and have sufficient funds, etc. Similarly, certain countries require that the Traveler produce evidence of insurance/repatriation coverage before it will issue a visa. You must carefully observe all applicable formalities and ensure that the surnames and forenames used for all passengers when making a booking and appearing in your travel documents (booking forms, travel tickets, vouchers, etc.), correspond exactly with those appearing on your passport, visas, etc.

Requirements for traveling to India change frequently, often with little advance notice, and changes may be poorly advertised and inconsistently enforced. Travelers are urged to check the website of the Indian Embassy in Washington, D.C. (https://www.indianembassy.org/) before any travel to India to review the most current information. We recommend that you check these before booking and also shortly before departure as requirements may change.
Immunization requirements vary from country to country and even region to region. Up-to date information should be obtained from your local health department and consulate. You assume complete and full responsibility for, and hereby release Shiva Travel from, any duty of checking and verifying vaccination or other entry requirements of each destination, as well as all safety and security conditions of such destinations during the length of the proposed travel or extensions expected or unexpected. It is your responsibility to ensure that you hold the correct, valid documents for the countries you are visiting and have obtained the necessary vaccinations, clearance to travel, and hold the necessary confirmations for medications required as we cannot be held liable for any illness, delays, compensation, claims and costs resulting from your failure to meet these requirements.
WE CANNOT ACCEPT RESPONSIBILITY IF YOU ARE REFUSED PASSAGE ON ANY AIRLINE, CRUISE, TRANSPORT OR ENTRY INTO ANY COUNTRY DUE TO THE FAILURE ON YOUR PART TO CARRY OR OBTAIN THE CORRECT DOCUMENTATION. IF FAILURE TO DO SO RESULTS IN FINES, SURCHARGES, CLAIMS, FINANCIAL DEMANDS OR OTHER FINANCIAL PENALTIES BEING IMPOSED ON US, YOU WILL BE RESPONSIBLE FOR INDEMNIFYING AND REIMBURSING US ACCORDINGLY.
Although most travel to participating destinations is completed without incident, travel to certain areas may involve greater risk than others. You assume sole responsibility for your own safety at any destination traveled to. Shiva Travel does not guarantee your safety at any time, and assumes no responsibility for gathering and/or disseminating information for you relating to risks associated with your destinations. BY OFFERING OR FACILITATING TRAVEL TO CERTAIN DESTINATIONS, WE DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND WE SHALL NOT BE LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.
Shiva Travel strongly recommends that all Travelers purchase some form of Travel, Cancellation, Lost Baggage and/or Medical Emergency Insurance for all Trips. While we can refer you to an insurance company, Traveler acknowledges that it is Traveler’s responsibility to understand the limitations of their insurance coverage and purchase additional insurance as needed. It is the Traveler’s sole responsibility to research, evaluate and purchase appropriate coverage. Traveler agrees that Shiva Travel is not responsible for any uninsured losses.
Shiva Travel AND THE SERVICE PROVIDERS ASSUME NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, OR BROWSING IN THE Shiva Travel OR YOUR DOWNLOADING OF ANY MATERIALS, DATA, TEXT, IMAGES, VIDEO OR AUDIO FROM THE Shiva Travel. IN NO EVENT SHALL Shiva Travel OR ANY SERVICE PROVIDER BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (A) ANY USE OF THE Shiva Travel OR CONTENT FOUND HEREIN, (B) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF OR INABILITY TO USE ANY COMPONENT OF THE Shiva Travel FOR RESERVATIONS OR TICKETING), OR (C) THE PERFORMANCE OR NON-PERFORMANCE BY Shiva Travel OR ANY SERVICE PROVIDER, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY OTHER PARTY. SOME STATES DO NOT ALLOW LIMITATION OF LIABILITY, SO THE FOREGOING LIMITATION MAY NOT APPLY TO YOU.
If, notwithstanding the foregoing, Shiva Travel or any Service Provider should be found liable for any loss or damage that arises out of or is in any way connected with any of the above described functions or uses of the Shiva Travel or its content, the liability of each of Shiva Travel and Service Providers shall in no event exceed, in the aggregate, the greater of (a) the transaction fees assessed for your transactions on the Shiva Travel, or (b) US $100.00. In its sole discretion, in addition to any other rights or remedies available to Shiva Travel and without any liability whatsoever, Shiva Travel at any time and without notice may terminate or restrict your access to any component of the Shiva Travel.
